TERMS AND CONDITIONS

1. DEFINITIONS

1.1 “Event” or “the Spooky Swamp” means the Spooky Swamp event held at the Venue.

1.2 “You” means you as the holder of the Ticket and “Your” shall be read accordingly.
1.3 “Event Organiser”, “we”, “our” or similar wording means Stonebridge Golf Centre Limited of Packington Hall, Meriden, Warwickshire, CV7 7HF.
1.4 “Terms and Conditions” means these terms and conditions.
1.5 “Venue” means the site at which the Event takes place being as follows: Stonebridge Golf Club, Somers Rd, Meriden, Coventry CV7 7PL.
1.6 “Ticket” means any valid ticket which permits you to attend the Event or any valid wristband for which you have exchanged your valid ticket at the Event.
1.7 “Force Majeure” means any cause beyond the Event Organiser’s reasonable control including, without limitation, an act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, royal mourning, national mourning, theft of essential equipment, malicious damage, strike, lock out, third party injunction, national defence requirements and/or acts or regulations of national or local governments.

2. INTRODUCTION

2.1 These Terms and Conditions set out the terms applicable between You and the Event Organiser in relation to Your attendance at the Event.
2.2 These Terms and Conditions are subject to change from time to time without notice and in our sole discretion. Updated Terms and Conditions will be posted on www.spookyswamp.co.uk

3. TICKET PURCHASE AND DELIVERY

3.1 If you or any member of your party has particular requirements you are required to raise these when booking and we will endeavour to address them but cannot guarantee the desired outcome. There is no guarantee any requirements can be met.
3.2 The Ticket you purchase remains the property of the Event Organiser and is a personal revocable license which may be withdrawn and admission refused at any time upon refunding the printed purchase price.
3.3 Tickets will be in the form of an E-Ticket sent to you by email.  Please bring this E-ticket with you for entry to the Event. This can also be printed and your name must be included and visible within this. ID may be required on entry (see 9.2 below). E-Tickets will be sent out in an email at least 1 week before the Event.

4. EVENT GENERAL INFORMATION

4.1 The Event is a family-friendly experience, suitable for all ages. However due to the nature of this Halloween event, some of the installations may be deemed unsuitable for younger children. We therefore advise parents and guardians of this in advance of booking and their visit, and to use their discretion in deciding whether the attraction (or any particular part of it) is suitable for any members of their family and party.
4.2 All children and vulnerable adults must be closely supervised by a responsible adult or guardian of 21 years or over at all times.  There is a maximum of 3 young people (15 years of age and under) for each responsible adult or guardian of 21 years or over. Unaccompanied children (15 years of age and under) will be refused entry and no ticket refund will be given.
4.3 Adults are not permitted to wait in the grounds.  A full entrance ticket is required for accompanying adults for children (15 years of age and under).
4.4 Event Stewards will be on hand throughout should you require any assistance.
4.5 To ensure the safety of our visitors and staff, all visitors must remain on the clearly-marked trail at all times. Please refrain from touching any of the installations, Event infrastructure, lights or any electrical equipment.
4.6 The Spooky Swamp is an outdoor, rural event. We therefore advise all visitors to wear appropriate outdoor clothing and footwear.
4.7 All advertised timings are approximate and subject to change. We reserve the right to change the published Event programme. Please see 8.4 below in the event that changes made by us amount to a “material change”.

5. REDEEMING VOUCHERS

5.1 You may redeem your PDF voucher in the marquee during your visit.
5.2 Vouchers must be presented along with a valid entry ticket for that Event day as specified
5.3 Vouchers can only be used on one single occasion and no change will be given
5.4 Vouchers have no cash value. All unredeemed vouchers will be regarded as donations to support our charitable partner for the Event.

6. CAR PARKING AND ARRIVAL TIME

6.1 Please check tickets for your arrival time.  Please do not arrive more than 15 minutes before your allotted time slot. You may not be able to enter early. The times of last admission into the Event are set out at 9.15.
6.2 All vehicles coming on to the site must have a car parking ticket. Vehicles without a car parking ticket will not be admitted.

7. COVID-19 SAFETY MEASURES

7.1 Safety remains our priority for visitors, staff and volunteers, to help keep everyone safe at The Spooky Swamp. We will implement applicable government guidance or legislation regarding Covid-19 to the best of our ability during the course of the Event and will review measures regularly.
7.2 In particular:

7.2.1 You should not visit the Event if you or a member of your household has had any Covid-19 symptoms in the last 10 days or has been instructed to isolate.
7.2.2 You should respect other visitors’ space especially on narrow footpaths, in the bathrooms and other indoor space;
7.2.3 Face coverings are recommended (but not essential unless Government Guidance dictates) in busy places including the marquee;
7.2.4 You should wash your hands before you come and during your visit. Please bring your own hand sanitiser and use throughout your visit;

8. TICKET EXCHANGES AND REFUNDS INCLUDING ON CANCELLATION OR RESCHEDULING OF THE EVENT

8.1 Tickets may not be transferred, exchanged or resold. We may cancel any ticket booking which we reasonably believe has been made with a view to resale.
8.2 Tickets cannot be refunded except as set out below.
8.3 Tickets cannot be exchanged or refunded unless the Event is cancelled, abandoned, rescheduled or there has been a change to the Event that makes it materially different to the Event that purchasers would reasonably expect (a “material change”).
8.4 If the Event is cancelled or abandoned (including as a result of government Covid-19 restrictions or guidance) or if there has been a “material change”, we may offer you the opportunity to transfer your ticket to another event on an alternative date. If you do not wish to transfer your ticket you will be entitled to a refund in accordance with the ticket agent’s terms applicable when you purchased the ticket.

8.5 If the Event is postponed or rescheduled to another date(s), we will offer you the opportunity to transfer your ticket to an alternative date. If you do not wish to transfer your ticket you will be entitled to a refund in accordance with the ticket agent’s terms applicable when you purchased the ticket.
8.6 Our liability for the cancellation, abandonment, rescheduling or postponement of the Event, or for material changes to the Event, will be limited to a refund of the face value of the ticket. Personal arrangements including travel, subsistence and accommodation which have been arranged are made at your own risk and neither us nor the ticket agent will have any liability for such expenditure.
8.7 If cancellation takes place part-way through the Event, you may only be entitled to a refund of part of the face value of the Ticket.

9. ADMISSIONS POLICY

9.1 Anyone under the age of 16 must be accompanied by a responsible parent or guardian of 21 years or older. We reserve the right to have a maximum of three Youth/Child ticket holders per adult of 21 years or older (at the start date of the Event 21/10/21).
9.2 The following ID can be used as proof of age for entering the site: Current Passport, Current UK Driver’s License or Provisional License, Citizen Card, Pass Card, Student Card or other identification card from a recognised or accredited organisation.
9.3 Searching may be a condition of entry to the Event. The Event Organisers reserve the right to conduct security searches and confiscate any item which in the opinion of the Event Organisers may cause danger or disruption, be a health and safety risk, not be suitable to be taken into the Event or is one of the items not permitted in the venue as detailed in these Terms and Conditions.
9.4 The Event is about quality performance and entertainment and the freedom for all to enjoy it. Anyone found in possession of illegal substances including psychoactive substances or contraband goods will be refused admission to or ejected from the Venue and may also be liable for prosecution. Any items found that may be used in an illegal or offensive manner will be confiscated, regardless of whether or not the item itself is illegal.

9.5 You shall not bring all or any of the following into the Venue: pyrotechnics, fireworks, flares, laser pens, laser equipment, high power torches, personal sound systems, animals (except assistance dogs).
9.6 You shall not bring any bottles or glass containers to the Venue, or any item which the Event Organiser considers could be used as a weapon (including sharp or pointed objects such as knives), items with an open flame (e.g. candles, barbecues, gas/paraffin lamps, Chinese lanterns, camp fires, etc).
9.7 The Event Organiser reserves the right to refuse you entry to and/or eject you from the Event without refund if you breach these Terms and Conditions or if your behaviour otherwise fails to meet our required standards. In particular but without limitation you may be refused admission to or removed from the Event for any reason which may include but are not limited to: for health and safety or licensing reasons; if you behave in a manner which has or is likely to affect the enjoyment of other persons at the Event; if you use threatening, abusive or insulting words or mannerisms; if, in the Event Organisers reasonable opinion, you are acting in an inappropriately under the influence of alcohol or drugs; if you demonstrate any form of anti-social behaviour; if you fail, when required, to produce proof of identity or age; if you refuse to comply with the Event’s security protocols; if you carry offensive weapons or illegal or prohibited items or substances if you breach these Terms; and/or if your Ticket is void. You will not be permitted to return to the Event site or purchase further tickets.
9.8 You shall not bring any drinks or food for consumption by yourself or others at the Venue during your visit. This includes any form of alcoholic beverage.
9.9 You must comply with any and all instructions given to You by the Event Organiser and/or all Venue stewards and staff at the Event.
9.10 Prolonged exposure to noise may cause damage to hearing. Please be aware that lighting may be used as part of certain installations. We strongly recommend all minors wear ear defenders and all attendees take any precautions they deem necessary, especially those individuals with photosensitivity.

9.11 Strictly no trading of any goods or services is allowed at the Venue or the Event without the consent of the Event Organiser.
9.12 By attending the Event you give Your express consent to Your actual or simulated likeness being included within any film, photograph, audio and/or audio-visual recording to be exploited in any and all media for any purpose at any time throughout the world, the copyright to which shall be owned by the Event Organiser or its contractors without payment or compensation. If you attend the Event with Your child aged under 16 years you are foregoing Your express consent on their behalf. This includes filming by any local Authority or security staff that may be carried out for the security of customers.
9.13 You are asked to observe and comply with safety advice, site signage and ‘No Smoking’ areas. In accordance with Smoke-Free Regulations, the tented areas and other areas of the Event are designated ‘No Smoking’ areas. Normal statutory rules and regulations apply and should be observed at the Event and failure to do so may result in ejection from the Event.
9.14 You shall not bring into the Venue or display or distribute (whether for free or otherwise) at the Event any sponsorship, promotional or marketing materials.
9.15 There will be no admission to the Event outside the designated opening and closing times on any day of the Event. Last admission to the Event will be at the following times:

10. TICKET EXCHANGES AND REFUNDS INCLUDING ON CANCELLATION OR RESCHEDULING OF THE EVENT

10.1 The Event Organiser shall have no liability whatsoever in connection with Your booking, use and/or occupation of any accommodation in connection with Your attendance at the Event for example hostels, hotels, B&Bs or apartments.
10.2 It is strictly prohibited for any visitor to the Venue or the Event to stay overnight in any manner at the Venue or any land associated with the Venue.

11. THE SALE OF ALCOHOL

11.1 The Spooky Swamp operates a Challenge 25 policy. Drinks bought on presale will only be exchanged with proof of ID. If you are lucky enough to look youthful, please bring ID to the Event as you will be asked to show ID by staff when buying alcohol.
11.2 Please be aware proxy purchasing (the purchase of an alcoholic drink by someone of age, for an individual who is under 18), is strictly prohibited.

12. LIABILITY

12.1 You agree that the Event Organiser, its employees, servants or agents will not be liable for any loss, injury or damage to any person (including yourself) or property however caused (including by the Event Organiser or its servants or agents): (a) in any circumstances where there is no breach of a legal duty of care owed by the Event Organiser or any of its servants or agents; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (excluding  death or personal injury as a result of a breach of a legal duty of care owed by the Event Organiser, its servants or agents); and/or (c) to the extent that any loss or damage results from the breach by you of any of these Terms and Conditions.

12.2 The Event Organiser will not be liable to you for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.

12.3 You agree that the Event Organiser shall not be liable to you for any indirect or consequential costs, claims, actual or alleged losses howsoever arising out of or in connection with the Event and/or our obligations hereunder including, but not limited to, loss of profits, anticipated profits, savings, business or opportunity, or loss of publicity or loss of reputation, or opportunity to enhance reputation, or loss of contract or other economic or consequential loss arising from the performance (or any failure to perform) these Terms and Conditions.

12.4 The Event Organiser shall have no liability whatsoever in connection with Your booking, use and/or occupation of any accommodation outside the Venue in connection with Your attendance at the Event, for example hostels, hotels, B&Bs or apartments.

12.5 Nothing in these Terms and Conditions shall purport to limit any liability which cannot legally be limited, including liability for death or personal injury caused by negligence, and for fraud or fraudulent misrepresentation.

13. OTHER PROVISIONS

13.1 The Event Organiser shall be entitled to assign its rights and obligations under these Terms and Conditions, provided that Your rights are not adversely affected.The Event Organiser shall be entitled to assign its rights and obligations under these Terms and Conditions, provided that Your rights are not adversely affected.

13.2 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Terms and Conditions valid or enforceable.

13.3 If the Event Organiser delays or fails to enforce any of these Terms and Conditions it shall not mean that the Event Organiser has waived its right to do so.

13.4 Any person, other than the Event Organiser, who is not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions.

13.5 Nothing in these Terms and Conditions and no action taken by You or the Event Organiser under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other fiduciary relationship between You and the Event Organiser.

13.6 These Terms and Conditions constitute the entire agreement between the parties in connection with the subject matter of these Terms and Conditions and supersede any previous terms and conditions, agreement or arrangement between You and the Event Organiser relating to the subject matter of these Terms and Conditions.

13.7 These Terms and Conditions shall be governed by the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
